General Terms and Conditions

  1. Scope of application

These General Terms and Conditions apply to all services provided by Jennifer Melchert Personal Trainer (hereinafter: Coach Jennifer), in particular in the areas of personal training, Hyrox Performance Coaching, nutrition coaching as well as online coaching and digital programs.

By booking a service, the customer agrees to these GTC.

 

  1. Services

Coach Jennifer offers individual services in the field of:

  • Personal training, fitness training
  • Hyrox Performance Coaching
  • Performance diagnostics, BIA body analysis, nutrition coaching
  • Online coaching (e.g. via video call, app, training platform)
  • Training plans and digital programs
  • Personal support and check-ins

The specific scope of services is set out in the respective offer booked.

Coach Jennifer does not owe any specific physical or health success, but rather the professional execution of the agreed services.

 

  1. Obligations of customers

The customers commit themselves:

  • to have their physical health checked on their own responsibility before the start of the coaching and to seek medical advice if necessary
  • provide all health-related information truthfully
  • implement the agreed training and nutritional recommendations on their own responsibility
  • to inform Coach Jennifer immediately of any changes in health or complaints

 

  1. Terms of payment
  • The prices are based on the respective offer.
  • Payment is made monthly in advance as a one-off payment.
  • In the event of late payment, the service shall be suspended until payment is received.
  • Reminder fees may be charged.

 

  1. Cancellations & postponements

Personal training / coaching appointments

  • Cancellations by customers must be at least 24 hours before the appointment take place.
  • In the event of late cancellation or no-show, the appointment will be charged in full.
  • Cancellations by Coach Jennifer will be communicated in good time; an alternative date will be offered.

Online appointments are subject to the same regulations.

 

  1. Online coaching & digital services

In the case of online services, support is provided via digital means of communication. The customers themselves are responsible for:

  • Stable Internet connection
  • Functioning technical equipment
  • Suitable training environment

Coach Jennifer accepts no liability for technical faults that are beyond her control.

 

  1. Liability

Participation in all training and coaching offers is at your own risk.

Coach Jennifer is only liable for willful or grossly negligent behavior.

Coach Jennifer is only liable for slight negligence in case of violation of essential contractual obligations and limited to the foreseeable, contract-typical damage.

No liability is assumed for health risks arising from incomplete or incorrect information provided by the customer.

 

  1. Confidentiality

All personal information disclosed during coaching will be treated confidentially.

It will only be passed on:

  • with express consent
  • or due to legal obligation

 

  1. Data protection

Personal data is processed in accordance with the Swiss Data Protection Act (DPA) and - where applicable - the GDPR.

Only data that is required for the coaching session (e.g. name, contact details, health details) is collected. The data will not be sold or passed on to third parties.

 

  1. Copyright

All content provided (training plans, videos, concepts, documents) are the intellectual property of Coach Jennifer. Passing on, copying or commercial use is not permitted without written consent.

 

  1. Termination

Both parties may terminate the collaboration at any time within one week, unless otherwise agreed. Services and payments already made will not be refunded.

 

  1. Applicable law & place of jurisdiction

The law of the Canton of Zurich, Switzerland, shall apply. The place of jurisdiction is Zurich.
